COUNTY COMMISSION
The Honorable Daviess County Commission met this 12th day of August 2020 at 8:15 a.m. Jim Ruse, Presiding Commissioner, called the meeting to order. Wayne Uthe, 2nd District Commissioner, was present. David Cox, 1st District Commissioner, was absent dealing with recent storm damage.
James Lewis, Bridge Supervisor, met with the Commission to update them on ongoing work. James advised that they are continuing to work on repairing/replacing tubes and repairing bridges in Jefferson and Jamesport Townships. The brush mower is continuing to mow in Salem Township.
Kyle Cornett, Courthouse Security, met with the Commission to verify some security procedures.
Lance Rains, City of Gallatin, met with the Commission to sign the final paperwork for the city’s CARES grant funding and receive their check.
Cheryl Alexander, Daviess County Health Director advised the Commission the county now has 17 total coronavirus cases, with 5 still active. Cheryl also reported Jamesport school is now in session. Later in the day Cheryl reported Daviess County had two new positive cases, with an additional case pending test results.
Discussion was held regarding CARES Act Funding Applications received. The Commission wants to encourage all businesses to apply for this grant funding. Almost every business in Daviess County will qualify for some kind of reimbursement. Applicants should contact the County Clerk’s office for more information.
Discussion was held regarding the ongoing courthouse roof repairs. Jim Ruse reported that many of the leaks had been fixed. Ongoing work will address what is left.
Discussion was held regarding the petition to close a portion of Quartz Avenue in Union Township. Issue continued until next week.
Discussion was held regarding the trimming of the bushes around the courthouse. Jim Ruse stated he had been in contact with Mitchell Ott and the work should be completed soon. Issue continued until next week.
Applications for the custodian position were reviewed. Four applicants were chosen to do a day of trial cleaning. Results of the trials will be reviewed on Wednesday, Aug 19th. Issue continued until next week.
Wayne Uthe made a motion to send Kyle Cornett, Courthouse Security, to attend Security training in Kansas City, Jim Ruse seconded. 2-Aye, 0-No. Motion passed.
Elizabeth Plottner, Daviess County Library, met with the Commission to sign the final paperwork for the library’s CARES grant funding and receive their check.
Jane McKinsey, Recorder, brought peanut butter cookies for the Commission, and advised them the Clinton County Recorder had filed their resignation.
Aaron McVicker, McClure Engineering, met with the Commission to discuss ongoing projects and any new projects the county might be considering. Discussion was held regarding BRO and Soft Match balances available for bridge projects.
The Sheriff’s office presented the Commission with grant paperwork to finish up a DWI Enforcement grant. The paperwork was signed by Jim Ruse, Presiding Commissioner.
Notice was received from Windstream that two tower locations in Daviess County would be receiving upgraded equipment.
Notice was received from Jamesport Roofing that they were available for roofing construction and repairs.

CIRCUIT COURT
Before Judge Jason Kanoy on Aug. 11, a jury trial for Corey Stiner was set for Jan. 28-29, 2021, in a change of venue case from Livingston County. Stiner is charged with two counts of child molestation first degree, A felonies.
The following cases were heard by Judge Ryan Horsman on Aug 5:
In Kendall Petrie et al vs. Robert M. Neal, a quiet title was granted to the plaintiffs Kendall and Nancy Petrie of Berryton, KS.
A dissolution of marriage was granted to Mahana Pacheco from Hamblyn Pacheco, with her maiden name of Mahana Stephens restored.
A dissolution of marriage was granted to Rachel Trimble from Brent Trimble, with her maiden name of Rachel Rhoades restored.
Michael Sprague vs. the State of Missouri was dismissed by the parties on Aug. 10.
Cases bound over from the Associate Division: State vs. Randy L. Worthey, Gallatin, domestic assault second degree, D felony, no valid license third and subsequent offense, E felony, and misdemeanors of drug paraphernalia, and two counts of property damage second degree.
Civil cases filed: Jennifer Trevisanut vs. Timothy B. Wilson, both of Gallatin, dissolution of marriage.

ASSOCIATE DIVISION
Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $74.50 for moving traffic violations and $120.50 in most criminal cases. Judge Daren L. Natalia A. Irby, Gallatin, careless and imprudent driving, suspended imposition of sentence, one year probation, 8 hours of community service.
Michael J. E. Hiley, Altamont, two counts animal abuse, suspended imposition of sentence, two years probation on each count.
Tylor S. Periman, Winston, animal abuse, suspended imposition of sentence, two years probation.
Kelly J. Frazier, Kansas City, KS, violation of order of protection, 90 days jail, suspended execution of sentence, two years probation.
Elias K. Gakunzi, Iowa City, IA, speeding, suspended imposition of sentence, one year probation, 20 hours of community service.

Breach of contract: A default judgment was entered for Cavalry and against David Blackburn. Creditbox.com LLC vs. Linda Berten was dismissed by the parties.
Suit on account: Capital One Bank vs. Danny R. Souders was dismissed by the parties.
